This Catering Services Contract (“Agreement”) is entered into by and between Hebrews Coffee Company LLC (“Company” or “Caterer”), located in Winder, Georgia, and the undersigned individual or entity (“Client”).

Welcome to Hebrews Coffee Company LLC. These Terms & Conditions (“Terms”) govern your use of the Hebrews Coffee Company LLC website and the purchase or booking of our mobile coffee and espresso catering services.

By submitting an inquiry, requesting a quote, accepting a proposal, booking our services, making a payment, or otherwise engaging Hebrews Coffee Company LLC for an event, you acknowledge that you have read, understand, and agree to these Terms.

1. Services

Hebrews Coffee Company LLC provides mobile coffee and espresso catering services for weddings, corporate events, private parties, showers, celebrations, schools, office events, and other gatherings.

Services may include, depending on the package or quote selected:

  • Mobile espresso cart and equipment

  • Espresso beverages

  • Coffee and other coffee-based beverages

  • Teas

  • Hot chocolate

  • Milk and alternative milk options

  • House-made syrups and selected flavor options

  • Cups, lids, stirrers, and other service supplies

  • Professional barista service

  • Setup and breakdown of equipment

  • Approved customizations, signage, branded cups, menus, or other add-ons

The specific services provided for an event will be determined by the Client's accepted quote, proposal, invoice, booking confirmation, service agreement, or other written event details.

2. Quotes & Event Pricing

All quotes provided by Hebrews Coffee Company LLC are based on the information provided by the Client at the time the quote is prepared.

Pricing may be affected by factors including:

  • Number of guests

  • Event duration

  • Event location and travel distance

  • Number of baristas required

  • Menu selections

  • Equipment requirements

  • Customizations

  • Additional services or add-ons

  • Changes to event details

A quote does not constitute a confirmed booking.

Hebrews Coffee Company LLC reserves the right to adjust pricing if the Client changes the event details after the quote has been provided or accepted.

Changes may include additional guests, service time, staffing, travel, menu items, equipment, supplies, customizations, or other event-related expenses.

Any additional charges will be communicated to the Client before the additional services are provided whenever reasonably possible.

3. Booking Fee

A non-refundable booking fee equal to 30% of the total contracted amount is required to reserve an Event date.

The booking fee is credited toward the total amount due for the Event.

The Event date is not considered reserved until both of the following have been received:

  1. Acceptance of the applicable service agreement or booking terms; and

  2. Payment of the required booking fee.

Until both requirements are satisfied, Hebrews Coffee Company LLC may continue to make the requested date available to other Clients.

4. Payment

The remaining 70% balance is due no later than 10 calendar days before the Event date, unless otherwise agreed upon in writing.

If the remaining balance is not received by the due date, Hebrews Coffee Company LLC may treat the Event as cancelled by the Client and retain the non-refundable booking fee, subject to applicable law.

Hebrews Coffee Company LLC is not obligated to provide services until the Client's account has been paid in full.

5. Guests & Event Details

The Client agrees to provide accurate information regarding the Event, including:

  • Expected number of guests

  • Event date

  • Event location

  • Service hours

  • Venue requirements

  • Menu selections

  • Special requests

  • Other information reasonably requested during the booking process

The guest count provided by the Client will be used to determine staffing, supplies, equipment, beverages, and pricing.

If the Client provides inaccurate information or requests changes after the Agreement is accepted, Hebrews Coffee Company LLC reserves the right to adjust the total price to account for additional guests, service time, staffing, travel, menu items, equipment, supplies, or other changes.

Any additional charges resulting from changes to the Event will be communicated to the Client before the changed services are provided whenever reasonably possible.

6. Venue & Setup Requirements

The Client is responsible for confirming that the Event venue permits Hebrews Coffee Company LLC to provide mobile coffee and espresso catering.

Unless otherwise agreed upon in writing, Hebrews Coffee Company LLC requires a safe and accessible setup area of approximately 6 feet by 8 feet.

Hebrews Coffee Company LLC requires access to at least one dedicated 15- or 20-amp electrical circuit for espresso equipment. The circuit must not be shared with other high-draw equipment.

The Client is responsible for providing reasonable and safe access to the Event location, including access necessary for unloading, setup, service, and breakdown.

The Client is also responsible for communicating any applicable venue rules, restrictions, parking requirements, loading restrictions, permits, or other requirements that may affect the Company's ability to perform the Services.

If required electrical service, setup space, access, parking, or other agreed-upon venue requirements are unavailable, Hebrews Coffee Company LLC may be unable to operate certain equipment or may need to modify the Services.

Hebrews Coffee Company LLC is not responsible for service limitations caused by inadequate venue facilities or circumstances outside the Company's reasonable control.

7. Service Hours & Overtime

Hebrews Coffee Company LLC will provide Services during the service period stated in the Client's accepted quote, proposal, invoice, booking confirmation, or service agreement.

Additional service time requested by the Client, or required because the Event schedule extends beyond the contracted service period, is subject to Company availability and additional fees.

Overtime will be billed at Hebrews Coffee Company LLC's then-current hourly rate.

The applicable overtime rate will be communicated to the Client before additional service is provided whenever reasonably possible.

Hebrews Coffee Company LLC is not required to extend service beyond the contracted service period.

8. Rescheduling

If the Client needs to reschedule the Event, Hebrews Coffee Company LLC will work with the Client in good faith to transfer the booking to a new date, subject to Company availability.

A rescheduled Event is not guaranteed until the new date has been confirmed by Hebrews Coffee Company LLC.

The original booking fee will be applied to the rescheduled Event.

If the new Event date requires additional travel, staffing, services, equipment, supplies, or other costs, Hebrews Coffee Company LLC reserves the right to adjust the total price accordingly.

9. Cancellation Policy

If the Client cancels the Event at any time, the 30% booking fee is non-refundable.

If the Client cancels after the remaining balance has been paid, Hebrews Coffee Company LLC will refund the unused portion of the remaining balance after deducting the cost of supplies, ingredients, custom items, materials, or other Event-specific expenses already purchased or committed by the Company for the Event.

The original 30% booking fee remains non-refundable regardless of when the cancellation occurs.

10. Hot Beverage Safety

Hebrews Coffee Company LLC serves hot beverages that may cause burns or other injuries if spilled, dropped, improperly handled, or consumed improperly.

The Client and Event guests are responsible for exercising reasonable care when receiving, transporting, handling, and consuming hot beverages.

Hebrews Coffee Company LLC will take reasonable precautions in preparing and serving hot beverages but shall not be responsible for injuries resulting from a guest's negligent or improper handling, spilling, dropping, or consumption of a beverage, except to the extent caused by Hebrews Coffee Company LLC's negligence or other liability that cannot legally be excluded.

11. Allergies & Dietary Restrictions

Hebrews Coffee Company LLC will make reasonable efforts to accommodate disclosed dietary restrictions or ingredient preferences when those needs are communicated and agreed upon in advance.

The Client acknowledges that Hebrews Coffee Company LLC uses ingredients that may contain or come into contact with common food allergens.

Hebrews Coffee Company LLC cannot guarantee that any beverage, ingredient, equipment, or preparation area will be completely free from allergens or cross-contact.

Guests are responsible for informing Company staff of known allergies before consuming a beverage and for making informed decisions regarding whether a beverage or ingredient is safe for them to consume.

Hebrews Coffee Company LLC may provide ingredient or allergen information when reasonably available and appropriate.

Hebrews Coffee Company LLC shall not be responsible for an allergic reaction resulting from a guest's consumption of a product when the Company has reasonably disclosed the applicable ingredients or allergen information, except to the extent caused by the Company's negligence or other liability that cannot legally be excluded.

12. Equipment & Property

Hebrews Coffee Company LLC will provide the equipment, coffee service items, and supplies included in the Client's booking.

The Client agrees not to move, operate, alter, or permit guests to operate Company equipment without permission.

The Client may be responsible for damage to Hebrews Coffee Company LLC's equipment or property caused by the Client, guests, venue personnel, vendors, or other persons under the Client's control, except to the extent caused by the Company's negligence or other liability that cannot legally be excluded.

13. Indemnification

To the fullest extent permitted by law, the Client agrees to indemnify, defend, and hold harmless Hebrews Coffee Company LLC, its owners, employees, contractors, and agents from claims, damages, liabilities, losses, costs, and reasonable expenses arising from the acts or omissions of the Client, the Client's guests, invitees, vendors, or other persons under the Client's control in connection with the Event.

This indemnification obligation does not apply to the extent that a claim is caused by Hebrews Coffee Company LLC's negligence, willful misconduct, or other liability that cannot legally be excluded.

14. Force Majeure & Circumstances Beyond Our Control

Hebrews Coffee Company LLC will not be responsible for failure or delay in performing Services caused by circumstances beyond its reasonable control, including:

  • Severe weather

  • Natural disasters

  • Fire

  • Power outages

  • Government action

  • Venue closure

  • Road closures

  • Accidents

  • Illness

  • Emergencies

  • Unsafe conditions

  • Other events that make performance unsafe or impracticable

Hebrews Coffee Company LLC will make reasonable efforts to communicate with the Client and, when possible, work toward rescheduling or another reasonable solution.

15. Limitation of Liability

To the fullest extent permitted by law, Hebrews Coffee Company LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to the Services.

Hebrews Coffee Company LLC's liability for any claim arising out of the Services will be limited to the amount actually paid by the Client to Hebrews Coffee Company LLC for the applicable Event, except to the extent such limitation is prohibited by applicable law.

Nothing in these Terms is intended to waive or limit liability that cannot legally be waived or limited.

16. Insurance & Independent Contractor Status

Hebrews Coffee Company LLC maintains general liability insurance applicable to its business operations.

The Client acknowledges that Hebrews Coffee Company LLC is an independent service provider and is not an employee, agent, joint venturer, or partner of the Client or the Event venue.

17. Photography & Media

The Client grants Hebrews Coffee Company LLC permission to photograph or record the Company's Services, equipment, setup, beverages, and general Event environment for use on the Company's website, social media, advertising, portfolio, and other marketing materials.

Hebrews Coffee Company LLC will make reasonable efforts to avoid prominently identifying guests who have not consented to being photographed.

The Client may opt out of this provision by providing written notice to Hebrews Coffee Company LLC before the Event.

18. Website Use

The content of the Hebrews Coffee Company LLC website is provided for general informational purposes.

Hebrews Coffee Company LLC makes reasonable efforts to ensure that information on the website is accurate and current but does not guarantee that all information, pricing, availability, descriptions, photographs, or other content is complete, current, or error-free.

Website content, including photographs, logos, graphics, written content, branding, menus, and other materials, is the property of Hebrews Coffee Company LLC or its respective owners and may not be reproduced, copied, modified, distributed, or used for commercial purposes without prior written permission, except where permitted by law.

19. Third-Party Services & Links

Our website may contain links to third-party websites, booking platforms, payment processors, social media platforms, or other services.

Hebrews Coffee Company LLC does not control and is not responsible for the content, privacy practices, security, availability, or policies of third-party websites or services.

Use of third-party services may be subject to the terms and privacy policies of those third parties.

20. Privacy

Information submitted through the Hebrews Coffee Company LLC website, inquiry forms, booking forms, or other communications is handled in accordance with our Privacy Policy.

By using our website or submitting information to Hebrews Coffee Company LLC, you acknowledge that you have had an opportunity to review our Privacy Policy.

21. Governing Law

These Terms and any service agreement between the Client and Hebrews Coffee Company LLC shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict-of-law principles.

22. Entire Agreement

For booked Events, the applicable service agreement, accepted proposal, invoice, booking confirmation, and any written Event-specific terms incorporated into those documents constitute the agreement between the Client and Hebrews Coffee Company LLC regarding the applicable Services.

These documents supersede prior oral or written discussions regarding those Services to the extent permitted by law.

23. Amendments

Any amendment or modification to an Event-specific service agreement must be agreed upon by both the Client and Hebrews Coffee Company LLC in writing.

An amendment becomes effective when accepted by both parties.

Hebrews Coffee Company LLC may update these website Terms & Conditions from time to time. Updated Terms will be posted on this website.

24. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified or severed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

25. Waiver

A party's failure to enforce any provision of these Terms shall not constitute a waiver of that provision or the right to enforce it in the future.

26. Electronic Signatures & Acceptance

This Agreement and other event-related documents may be executed electronically, including by electronic signature, digital signature, online acceptance, or other electronic means.

Electronic signatures and electronic acceptance shall have the same force and effect as an original handwritten signature to the fullest extent permitted by applicable law.

By electronically accepting an Agreement, proposal, booking confirmation, or other event-related document, the Client acknowledges that the Client has read, understands, and agrees to be legally bound by its terms.

27. Client Acceptance

By submitting an inquiry, accepting a quote or proposal, making a payment, signing an agreement, electronically accepting an agreement, or booking services with Hebrews Coffee Company LLC, the Client acknowledges that they have read, understand, and agree to these Terms & Conditions and any applicable Event-specific service agreement.
